ἐπειδὴ καὶ μετὰ τὸ αὐτοὺς τὸν ἑαυτῶν βίον ἀπολειτουργῆσαι, καταλεῖψαι ἀδιανεμήτως τὴν πᾶσαν αὐτῶν περιουσίαν ἔν τε τῷ ἀγρῷ τῆς ἡμῶν κώμης Ἀράβων καὶ ἐπὶ τῆς Ἀντινοέων πόλεως, καὶ μέρος οἰκήματος διακειμένου ἐπὶ τῆς αὐτῆς Ἀντινοέων πόλεως, ἔκ τε κινητῶν καὶ ἀκινήτων καὶ αὐτοκινήτων πραγμάτων καὶ π διῃρησάμεθα εἰς ἑαυτοὺς τὰ ὠνητὰ πράγματα τῶν εἰρημένων μακαριωτάτων ἡμῶν γονέων ἀπὸ πολυτιμίου μέχρι εὐτελοῦς καὶ ἀσσαρίου ἑνὸς παρὲξ τῶν ἐν τῷ ἀγρῷ πραγμάτων παρὰ διαφόρων ρωτι προσώπων τὴν χειρὶ ἡμῶν τουτ ως ἀμφοτερ τούτων κοινῶς παρʼ ἡμῶν πραθῆναι ὃν τρόπον δυνησόμεθα τὴν τούτων τιμὴν ἢ αὐτὰ τὰ πράγματα διαμερισθῆναι ἐφʼ ἡμισείας μοίρας δικαίῳ μερισμῷ. καὶ τὰ νῦν μετὰ ταῦτα, ἀμφιβολίας γεγενημένης μεταξὺ ἡμῶν ἀμφοτέρων περὶ τῶν εἰρημένων ἐν τῷ ἀγρῷ πραγμάτων τῶν αὐτῶν μακαριωτάτων ἡμῶν γονέων ἕνεκεν τοῦ τελοῦντος κτήματος εἰς τὸ κωμητικὸν τῆς ἡμῶν κώμης ικν οὗ τὴν συντέλειαν οὐκ ἠνεσχόμεθα φέρειν καὶ εἴσπραξιν τῷ δημοσίῳ λόγῳ, καὶ πολλάκις τοῦτο ἐβουλήθημεν τῷ ἀπόρῳ παραχωρῆσαι, στρέφειν τε οὐ μὴν ἀλλὰ καὶ τὴν ὑπόλοιπον κτῆσιν προφάσει τοῦ αὐτοῦ κτήματος, ἕως ὅτε κατὰ μεσιτείανμεσιτίαν τινῶν φίλων, ἐν οἷς καενος καὶ ὁ λαμπρότατος ἡμῶν θεῖος κατὰ μητέρα ὁ κύριος Κόλλουθος ὁ σκρινιάριος, ὑπεισήλθαμεν τὴν τούτων διοίκησιν ἀνὰ πάλιν καὶ μερισμὸν τούτων δίκαιον καὶ εὐάρεστον φίλοις θέσθαι ἀλλήλοις κατὰ τὰ δόξαντα μεταξὺ ἡμῶν ἀμφοτέρων ἐν ταύτῃ τῇ ἐγγράφῳ νομίμῳ διαιρέσει, διʼ ἧς ὁμολογεῖ ἀμφότερος ἡμῶν ἤδη λελογχέναιλελοχέναι τὸ ἀνῆκον αὐτῷ μέρος ὡς ἐξῆς διατέτακται. ὁμολογῶ τοίνυν ἐγὼ ὁ προγεγραμμένος Φιλήμων , διὰ ταύτης ἡμῶν τῆς δικαίας διαιρέσεως, εἰς κλῆρόν μου λελογχέναιλελοχέναι ἀπαραβάτως καὶ ἀμετανοήτως καθʼ οἷον δήποτε τρόπον ἢ χρόνον τὸ κτῆμα τὸ καλούμενον Ἀπαλασίας τὸ διακείμενον ἐπάνω τῶν νειλῴων ὑδάτων Παπνόμθεως, κατάντικρυ τοῦ μοναστηρίου τῆς τῆς πανσέπτου μνημης Ἄμα Ταπολλῶτος τῆς αὐτῆς πεδιάδος κώμης Ἀράβων, μετὰ παντὸς αὐτοῦ τοῦ δικαίου καὶ χρηστηρίων πάντων καὶ μονῆς καὶ πύργου καὶ λάκκου καὶ φυτῶν διαφόρων, ἐγκάρπων τε καὶ ἀκάρπων, καὶ φοινίκων, καὶ τῆς αὐτοῦ καθόλου περιοχῆς ἐντὸς καὶ ἐκτὸς, κατὰ τὰ ἀρχαῖα ὅρια υαριου, ἀρουρῶν εἴκοσι τεσσάρων πλέω ἔλαττον ἠπειρίου γῆς μετὰ μιᾶς ἀμπελοφορίμουἀμπελοφορίμο γῆς, καὶ τῆς προσδόσεως τῆς ἐκεῖσε οὔσης νήσου καὶ αὐτῆς μετὰ τῶν ἐπιγιγνομένων ὄχθων ἤτοι αἰγιαλῶν σὺν Θεῷ πρὸς πᾶσαν τύχην καὶ εὐκαιρίαν τούτων κατὰ καιρὸν ὀφθησομένων καὶ τῶν νῦν προσπαρακειμένων τῷ αὐτῷ κτήματι, καὶ τοὺς ἑπτὰ σὺν τούτῳ σικυῶνας καρποφορουμένους νῦν, ὥστε ἐμὲ μετὰ τῶν μετʼ ἐμὲ παραληψομένων τὴν πᾶσάν μου διαδοχὴν καὶ κληρονομίαν, τούτων ἁπάντων δικαίῳ σκοπῷ καὶ μερισμῷ, κατὰ τὰ μεταξὺ δόξαντα σύμφωνα, κρατεῖν καὶ κυριεύειν καὶ δεσπόζειν διὰ παντὸς ἀπὸ τοῦ νῦν εἰς τὸ παντελὲς· λελογχέναι ἐμὲ οὐδὲν ἧττον ἅμα τούτοις καὶ οἰκίαν ὁλόκληρον διακειμένην ἐπὶ τῆς αὐτῆς κώμης Ἀράβων, ἐγγὺς τῆς ἁγίας ἐκκλησίας τοῦ παναέθλου μάρτυρος Ἄπα Θεοδώρου, ἠνεῳγμένης ἐπὶ ἀπηλιώτην, σὺν αὐθεντικῇ τε αὐτῆς θύρᾳ καὶ τῇ ταύτης παραθύρω, μετὰ παντὸς αὐτῆς τοῦ δικαίου καὶ τῆς συνημμένης ταύτῃ τῇ οἰκίαι ἐπαύλεως καὶ πασης τῆς τούτων περιοχῆς καθόλου καὶ δυσὶ φρέασι, ἁπαξαπλῶς μετὰ παντὸς ἐκ τούτων ὑπεισενηνεγμένου ἐκδοσίμουἐκτοσμου καὶ ἐκδότουἐκτόστου ἐνοικίουἐνοικείου ἐπὶ τῷ ἐξεῖναί μοι τῷ προγεγραμμένῳ Φιλήμονιφιλημωνι μετὰ τῶν μετʼ ἐμὲ κληρονόμων καὶ διαδόχων καὶ διακατόχων τούτων κρατεῖν διηνεκῶς αἰωνίως δεσποτικῷ δικαίῳ, ἀκωλύτως καὶ ἀνεμποδίστως ὑπαναγκὲς τὸ σύνολον. καὶ προσεπὶ τούτοις λελογχέναι ὁμοίως πρόσωπα δύο αὐτοκασίγνητα, προσηγορευμένα τὸν μὲν ἄρσενα ὀνόματι Βήσατος, τὴν δὲ θήλειαν ὀνόματι Ματρώνας, μετὰ τῆς τούτων ἐπιγονῆς ἀεὶ συνεπομένης τούτοις, τοῦ εἰλη αὐτοῖς κατʼκαθʼ ἔτος πεκουλίου καὶ ἐμοὶ στελλομένου τωTranslations (1)
