μετὰ τὴν ἐμὴν τελευτὴν κρατεῖν καὶ κυριεύειν καὶ δεσπόζειν διὰ παντὸς τοῦ αὐτοῦ τρίτου μέρους μοναστηρίου ὁλοκλήρου μετὰ παντὸς αὐτοῦ τοῦ δικαίου καθὼς προγέγραπται καὶ χρῆσθαί σε καὶ οἰκονομεῖν καὶ διοικεῖν καὶ οἰκεῖν καὶ ἀνοικοδομεῖνἀνῳκοδομεῖν καὶ ἐκμισθοῦν καὶ νέμεσθαινέμεσθε ἐντεῦθεν ἤδη καὶ πάντα πράττειν καὶ ποιεῖν περὶ αὐτοῦ καθ’ ὃν ἐὰν αἱρῇαἱρῇς τρόπον ἀκωλύτως καὶ ἀνεγκλήτως μετὰ τὴν ἐμὴν τελευτὴν καὶ παραπέμψαι εἴς τε υἱοὺς καὶ ἐγγόνους καὶ ἑξῆς μεταπαραλημψομένους κληρονόμους καὶ διαδόχους καὶ διακατόχους εἰς τὸν ἅπαντα χρόνον μετὰ τὴν ἐμὴν τελευτὴν καὶ μὴ ἀντιποιήσασθαι μηδ’ ἄλλον τινὰ ὑ̈πὲρ ἐμοῦ μήθ’ υἱοὺς μήτε κληρονόμους μήτε διαδόχους μήτε διακατόχους τούτου τρόπῳ μηδενὶ παρευρέσει μηδεμιᾷ ἀλλὰ καὶ βεβαιώσειν μέ σοι ταύτην τὴν δωρεὰν πάσῃ βεβαιώσει ἀπὸ παντὸ διὰ παντὸς ἁπαξαπλῶς τοῦ ἀντιποιησομέ νου ἢσ ἐπελευσομένου σοι περὶ τούτου ἢ μέρους τούτου καθ’ ὁνδηποτοῦν τρόπον διὰ παντὸς ἐπάναγκες μέντοι γε σοῦ μὴ δυναμένου μήτε δυνηθησομένου ἐκβαλεῖν με ἀπὸ τοῦ σου συνοικεσίου εἰς ὅλον τὸν χρόνον τῆς ἐμῆς ζωῆς ἄχρι τῆς ἐμῆς τελευτῆς, εἰ δὲ ἐθέλησας ἐκβαλεῖν με ἀπὸ τοῦ σου συνοικεσίου πρὸ τῆς ἐμῆς τελευτῆς χωρὶς νομίμου αἰτίαςἐτίας ἤτοι πορνείαςπορνίαςπονίας ἐπὶ τῷ ταύτην μου τὴν δωρεὰν ἄκυρον εἶναι καὶ ἀνίσχυρον ἁπανταχοῦ προφερομένηνφροφερομένην. ἐπομνυμένην περὶ τούτου τόν τε παντοκράτορα θεὸν καὶ τὴν εὐσέβειαν καὶ νίκην τοῦ τὰ πάντα νικῶντος δεσπότου τῆς οἰκουμένης ΦλαυίουουΦλαυίουσυ Ἰουστίνου τοῦ αἰωνίου Αὐγούστου Αὐτοκράτορος ταῦθ’ οὕτως ἔχειν καὶ μηδὲν διεψεῦσθαι καὶ πρὸς σην ἀσφάλειαν ταύτην σοι ἐθέμην τὴν δωρεάν.Translations (1)
After my death, you are to have control, authority, and dominion over the entire third part of the monastery with all its rights, as previously written, and you may use, manage, administer, inhabit, rebuild, lease, and occupy it and carry out all actions and matters concerning it in whatever way you choose, without hindrance or reproach, after my death, and to transfer these rights to your sons and grandsons and successive heirs, successors, and possessors for all time after my death. No one, neither sons nor heirs nor successors nor possessors, shall contest this in any way or for any person associated with me, and I shall confirm this gift to you with all assurance against anyone who may contest or attempt to take it from you in any manner. Nevertheless, you shall not be able nor shall you attempt to expel me from your dwelling throughout the entire duration of my life until my death. If you decide to expel me from your dwelling prior to my death without lawful cause, namely fornication, this gift of mine is to be null and void everywhere presented. I swear by the Almighty God and the piety and victory of the master of all the world, Flavius Justinus, eternal Augustus Autocrat, that these things hold and that nothing is false, and for your security, I have made this gift to you.
